Additional Conditions

• Annex 1 - Mandatory Conditions

   

  1.(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
  
  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
  
  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
  
  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
  
  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);
  
  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
  
  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less characteristic in a manner which carries a significant risk of undermining a licensing objective;
  
  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2.  The responsible person must ensure that free potable water is provided on                request to customers where it is reasonably available.

   

  3. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4. The responsible person must ensure that -

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25ml or 35ml; and

  (iii) still wine in a glass: 125ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  5. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  6. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence (Section 19, Licensing Act 2003).

   

  7. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  8.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

   

  9. (1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  (2) For the purposes of the condition set out in paragraph 1-

  (a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (b)“permitted price” is the price found by applying the formula- 

                                            P = D + (D x V)

  where-

  (i) P is the permitted price,

  (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i)the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence, or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

  (3). Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

  (4). (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

   

   

• Annex 2 - Conditions consistent with the operating schedule

   

  Prevention of public nuisance

   

  Music Noise Levels for events of up to 499 people.

  The license holder shall be responsible for undertaking monitoring of music noise levels throughout all events.

  The music noise level shall not exceed 60dB at the designated monitoring location at the site boundary (the site entrance gate between Orchard Cottage and Johnsons Cottage).

  *60dB is a single measurement and not LAeq, 15 minutes.

  All noise measurement data shall be retained by the licence holder and made available to the local authority (Environmental Health and Licensing) within 7 days of a written request.

   

   

  Music Noise Levels for events of 500 people or more.

  The license holder shall be responsible for undertaking monitoring of music noise levels throughout all events.

  The music noise level shall not exceed the following levels at the designated locations during any event between the hours of 08:00 to 23:00hrs:

  1.              Maximum 110 dB at 1 metre from the stage.

  2.              Maximum 95dB at the sound desk (approximately 30 metres from the stage).

  3.              Maximum 65dB* at the designated monitoring location at the site boundary (the site entrance gate between Orchard Cottage and Johnsons Cottage).

  *65dB is a single measurement and not LAeq, 15 minutes.

  The music noise level shall not exceed the following levels at the designated locations during any event between the hours of 23:00 to 00:00hrs:

  1.              Maximum 100 dB at 1 metre from the stage.

  2.              Maximum 90dB at the sound desk (approximately 30 metres from the stage).

  3.              Maximum 60dB* at the designated monitoring location at the site boundary (the site entrance gate between Orchard Cottage and Johnsons Cottage).

  *60dB is a single measurement and not LAeq, 15 minutes

  All noise measurement data shall be retained by the licence holder and made available to the local authority (Environmental Health and Licensing) within 7 days of a written request.

   

  Public Safety

   

  Event Management Plan

  1.              The holder of the premises licence, or an agent on behalf of and with the authority of the licence holder, must produce a formal document, currently titled Event Management Plan, when any event or function with a possibility of 500 or more people attending, addressing methods by which the licence holder proposes to manage the following matters to ensure the licensing objectives are promoted:

   

  a)              the structure for the operational management of the event, including the composition and functions of any event liaison team or similar

  b)              the responsibilities of personnel engaged at the site

  c)              ticket sales and conditions of entry

  d)              procedures for the security of and issuing of tickets and wristbands

  e)              verification and regulation of the number of persons present on the event site

  f)              the safe and orderly ejection of persons from the site

  g)              the number and deployment of security staff and stewards

  h)              crowd safety

  i)              the reduction of crime and prevention of the supply/possession of drugs, safe handling of drugs by staff

  j)              the responsible sale of alcohol

  k)              the safety of temporary structures

  l)              the prevention of fire

  m)              the use of fireworks

  n)              procedures in the event of emergency

  o)              the provision of first aid

  p)              accident reporting procedures

  q)              the welfare of persons attending and working within the event site

  r)              the control of noise and the prevention of public nuisance

  s)              the control of litter and the disposal of waste;

  t)              sanitation provisions and the disposal of waste

  u)              provision of water and the disposal of waste water

  v)              the safety of food

  w)              missing persons, the safety of children, lost children and safeguarding

  x)              provision of facilities for disabled persons

  y)              contingency planning in the event of adverse weather or ground conditions

  z)              traffic management

   

   

  2.              A draft version of the Event Management Plan shall be circulated to all responsible authorities, and to the licensing authority (East Hants Council), not later than 56 days before the start of any event. The Event Management Plan (and any appendices) will clearly indicate a version number (or equivalent) and the date it was produced/modified.

   

  3.              Following the circulation of the draft Event Management Plan, the licence holder, or an agent on behalf of and under the authority of the licence holder, shall consult with all responsible authorities and shall take due account of any representation made by a responsible authority regarding the content of the document.

   

  4.              The Event Management Plan shall be finalised not later than 28 days before the start of an event and shall be circulated in final form to all responsible authorities and to the licensing authority.

   

  5.              The Licence holder must obtain written approval from the Licensing Authority for the Event Management Plan at least 14 days prior to each event.

   

  6.              Where, following the submission of the final version of the Event Management Plan but prior to the commencement of the event, the licence holder considers it necessary to make any adjustment to the Event Management Plan, the proposed adjustment shall be notified to the licensing authority, who may notify the relevant responsible authority. No adjustment shall be made to the Event Management Plan unless it is agreed with the licensing authority.

   

  7.              The Event Management Plan and any appendices form part of the operating schedule for this licence and therefore the details specified therein are to be treated as conditions of this premises licence. Where a person placed under a positive obligation to comply with a provision of the Event Management Plan (or its appendices) fails to do so, the failure shall be regarded as a breach of this condition of the premises licence.

   

  8.              Where, during the course of the event, the licence holder considers it necessary to deviate from any provision within the Event Management Plan (or its appendices), the matter shall be brought to the attention of representatives of the relevant responsible authority or authorities within the Event Liaison Team (or equivalent) who may approve such deviation. Any such decision shall be documented by the Event Liaison Team.

  Or if no ELT - Where, during the course of the event, the licence holder considers it necessary to deviate from any provision within the Event Management Plan, any such decision shall be documented by the licence holder (or someone on their behalf) including the reasons for the deviation.

   

  9.              Any planned event of more than 5000 people on site will need to be referred to the local Safety Advisory Group via the appropriate application and with time to be discussed at a meeting before the 56 days

  Security Staff

   

  10.              A minimum of 2 SIA registered security staff will be on duty at the premises during any event where attendance exceeds 500 people.

   

  11.              The number of SIA door supervisors to be engaged on any occasion shall be determined by the licence holder, taking into account such factors as the nature and duration of licensable activities proposed, the number, age and character of persons likely to attend, and any known risks to impact on the promotion of the licensing objectives. The licence holder shall make a written record of the number of door supervisors to be engaged and the factors taken into account by the licence holder. Any such record shall be produced to a police officer or authorised officer of the local authority on reasonable request.

   

  Environmental Health

   

  12.              The licence is restricted to 30 event days per calendar year where amplified music is played. The Licensing Team shall be informed in writing 56 days in advance of the event occurring.

   

  13.              The Event Management Plan (EMP) must include a scaled site plan which complies with the requirements of the Licensing Act for all events. The plan must be to the satisfaction of all the Responsible Authorities.”

   

   

   

   

   

   

• Annex 3 - Conditions from a hearing

   

  Event Management Plan

  1.              The premises licence holder shall ensure that a minimum of 2 security staff are on duty at each entrance to the event and check people for age, behaviour and intoxication before entering the venue.

   

  2.              The premises license holder shall ensure that all security staff will be readily identifiable to members of the public at all times by wearing high visibility clothing.

   

  3.              The premises licence holder shall ensure that security staff, wearing high visibility jackets, are available to see persons off the premises at the close of any event to ensure they do not linger or cause disorder and public nuisance.

   

  4.              The premises licence holder shall ensure that there are both male and female security staff members on duty at any event.

   

  Personal Licence Holder

  5.              The premises licence holder will ensure that a Personal Licence Holder is on duty at all times when alcohol is available for sale.

   

  Glassware

  6.              The premises licence holder shall ensure that all drinking vessels including bottle are to be made of polycarbonate, aluminium or other unbreakable material. Alcohol and soft drinks that are not available in such drinking vessels including bottles shall be decanted into appropriate drinking vessels at the bar.

   

  ID - Challenge 25

  7.              The premises licence holder shall ensure that a system is in place to ensure that every individual who appears to be under 25 years of age seeking to purchase or be supplied with alcohol at or from the premises, shall produce acceptable means of indemnification and age confirmation. Acceptable identification shall be a passport, photo driving license or PASS accredited photo ID. If the person seeking alcohol is unable to produce acceptable means of identification, no sale or supply of alcohol will be made to or for that person.

   

  Training

  8.              The premises licence holder shall ensure that a training package is in place in order for all staff involved with the sale or supply of alcohol to be sufficiently trained in licensing matters proportionate to their role and aware of their responsibilities. Particular attention should be paid to underage sales / ID verification and the refusal of alcohol sales a drunk person. Records shall be kept of this training, dated and signed by the staff member and trainer. Refresher training shall be completed at least every 12 months again with documented records made and to be available for inspection from Police and other responsible authorities.

   

  9.              A written record shall be retained at each bar to show the staff that have been authorised to sell alcohol. This shall be made available for inspection from Police and other responsible authorities on request.

   

  Refusals / Incident Books

  10.              The premises licence holder shall ensure that a refusals book / incident book or log is maintained at the premises. These records shall be maintained for a minimum of 1 year and be made available for inspection from Police and other responsible authorities on request.

   

  Local Residents

  11.              Local residents shall be informed of any event which may impact upon them no less that 7 days prior to the event.

   

  Lost Child

  12.              A written policy for dealing with lost children shall be prepared and implemented. All staff, including security, will be trained in this policy. Written records of this training will be signed by the member of staff and trainer, kept for a minimum of 12 months and made available for inspection from Police and other responsible authorities on request.

   

  Environmental Health

  13.              The event noise levels, shall comply with the following guidance “Noise Council Code of Practice on Environmental Noise at Concerts” (In this context the location is determined as rural)

   

  14.              The DPS (Designated Premises Supervisor) shall be in attendance when live music occurs.

   

  15.              The premises shall operate an incident book. Any incidents shall be recorded in detail and include, date, time, what action was taken and who wrote it. The incident book shall be available for immediate inspection by any responsible authority.

   

  16.              A log book shall be kept on site at all times, for inspection by the Responsible Authorities. Records shall be kept for a minimum of 2 years. All complaints about noise or disturbance shall be logged in the log book, with date, time, issue and a record of corrective actions that the licence holder has taken.
