• Annex 1 - Mandatory Conditions

   

  (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) Selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  4.

  (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  5. The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25ml or 35ml; and

  (iii) still wine in a glass: 125ml; and

  (b) customers are made aware of the availability of these measures

   

  6. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  7. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence (Section 19, Licensing Act 2003).

   

  8. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  9. Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

• Annex 2 - Conditions consistent with the operating schedule

   

  General Licensing Objective

   

  The small family festival in aid of Headley Youth Football Club (HYFC) will be an all ticketed event sold in advance to family and friends of HYFC. Tickets will be exchanged for wristbands on gate to gain entry. The bar serving area will be designated Adults only and we will be using the under 21 policy “If you do not look over 21 you will not be served alcohol” backed up by proof of age ID cards. (The only forms of acceptable ID will be Photo driving licence, Passport or PASS accredited photo id). The licensed area will be completely fenced off and full risk assessments will be undertaken for all activities along with public liability insurance. No alcohol will be allowed to be brought into the event and no alcohol will be allowed out of the fenced licensed area (Random searches on entry gate to assist in this by SIA security staff). The event will be managed by responsible adults with the help of a DPS and security staff/ Stewards as numbers dictate.

   

  The prevention of crime and disorder

   

  Local Police will be made aware of the planned event and will be kept informed of progress during the planning stage as required. Local Police will also be invited to attend the event at various times throughout its course (as per previous years).  Security/stewarding staff will be used to assist at the gate, in bar area and throughout site. (Including Car Park Area). The under 21 policy will be enforced as in “A” above. Portable lighting will be used in and around the car parking area which will also be monitored by security staff. Numbers will be restricted by ticket sales to a maximum of 1200 for which adequate security/steward cover is being provided.

   

  Public Safety

   

  The whole festival area is fenced off from the remainder of the playing fields and car parking. A First Aid station manned by qualified first aiders will be located within the fenced area. Adequate access for Emergency vehicles will be allowed for within fencing. Security/Safety lighting will be used both within fenced area and car parking in the form of mobile floods in car park and stage lighting in fenced area. Security staff / Stewards will be present throughout the event. Risk assessments will be completed for all activities within music festival. Local Police will be made aware of event and will be invited to attend at times throughout the day. A traffic flow system will be used to bring traffic off road and into field as quick as possible. All drinks served will be in plastic containers….no glass of any description will be allowed into the fenced area (except behind bar). Adequate litter bins will be provided.

   

  The prevention of public nuisance

   

  The festival will take place within a fenced ticketed area. Only ticket holders will be permitted in. Security and stewards will be available for people management, car parking and traffic flow. External portable lighting will be provided for car park and toilet area with stage lighting used for the arena. Police will be advised and will be invited to visit festival. Staging and speakers will be positioned away from adjacent properties. Traffic control system will be used which will keep majority of traffic off road.

  Adequate litter bins will be provided throughout the site.

  Respect local residents notices will be displayed on exits and verbal reminders of this policy given out at close of festival from stage.

   

  The protection of children from harm

   

  We are providing age appropriate entertainment for a family festival. Children under 16 only admitted with adults. Proof of age cards will be required for purchase of alcohol. Security and stewards will be around the site for the duration of the festival.

  People will be encouraged to attend as a family.

   

  The provision of live music between 0800-2300 is not licensable (and so any conditions relating to the provisions of live music do not apply) if:

   

  The performance is unamplified;

  The performance is amplified and takes place to an audience of no more than 200persons.

  The performance must take place when the premises are open for the supply/sale of alcohol for consumption on the premises.

   

  Conditions agreed with Environmental Health Protection 14 January 2014

   

  Before the event:

   

  1. All sound checks shall take place on the day. Measurements shall be recorded at 5m from the stage using a Svantek 949 Sound level meter. Measurements shall also be taken at the Western boundary of the field adjacent to the nearest affected property and at the mixing desk. With the measurements at the nearest affected property being equal to or below the 65dB(A) recommended in the Environmental Noise Control at Concerts guidelines a further measurement shall be taken at the mixing desk to provide a calibrated level that will control the output from the stage for the actual event.

   

  During the event:

   

  2. The Sound level meter shall remain within the confines of the mixing desk during the festival and will be set to provide one minute samples which will provide a slightly higher indication than the 15 minutes samples required.

  Having a calibrated level means the sound engineers can review and update the output level from the stage to ensure the maximum 65dB(A) level is not exceeded irrelevant of who is performing. 

   

  3. A detailed printout including the LAeq 15 minute samples shall be provided to the local authority after the festival.

   

  4. Mobile numbers for two people responsible for the event shall be provided on leaflets distributed to local residents, who can then be contacted in the unlikely event of a failing of the aforementioned measures.

   

  I have raised my concerns with the applicants Martin Choularton and he has agreed to the above conditions in principle. Should you in due course receive a satisfactory written agreement from the applicant to the above conditions, you may consider that my representations have been withdrawn.
