• Annex 1 - Mandatory Conditions

   

  1.(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
  
  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
  
  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
  
  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
  
  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);
  
  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
  
  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less characteristic in a manner which carries a significant risk of undermining a licensing objective;
  
  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2.  The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  3. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4. The responsible person must ensure that -

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25ml or 35ml; and

  (iii) still wine in a glass: 125ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  5. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  6. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence (Section 19, Licensing Act 2003).

   

  7. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  8.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

   

  9. (1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  (2) For the purposes of the condition set out in paragraph 1-

  (a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(a);

  (b)“permitted price” is the price found by applying the formula- 

                                            P = D + (D x V)

  where-

  (i) P is the permitted price,

  (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i)the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence, or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(a).

  (3). Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

  (4). (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

  Annex 2 - Conditions consistent with the operating schedule

   

  Prevention of Public Nuisance

  During live or recorded music only external doors with lobbies are to be used for entry and exit into the function room. These doors have self-closing devices.

  Froyle Park has a clear policy of closing doors and windows after 7pm to minimise noise pollution.

  Froyle Park will not erect a marquee or tent, allow fireworks or pyrotechnics or allow helicopter or hot air balloons on the country club grounds without the prior written approval of the local planning authority.

   

  Protection of children from harm

   

  Froyle Park will actively check proof of age to prevent the supply of alcohol to minors. All incidents will be recorded in the Froyle Park duty manager's book.

  If performances are presented at Froyle Park especially for children, where a parent or guardian is not present, Froyle Park will ensure that at least one attendant will be present per 50 children. Attendants will also be stationed by each exit.

   

   

   

• Annex 3 - Conditions from a hearing

   

   

  1.              A Noise Management Plan (NMP) shall be prepared in writing by the Premises Licence Holder in consultation with a suitably qualified acoustic consultant who is a Member/Associate Member of the Institute of Acoustics or an equivalent professional body.

  2.              The NMP shall be submitted in writing to the appropriate officer within the Council’s Environmental Health and Licensing departments.

  3.              The Noise Management Plan shall include detailed procedures and controls designed to prevent public nuisance arising from the operation of the premises, including but not limited to noise arising from:

  ·              amplified and unamplified music

  ·              low frequency bass noise

  ·              outdoor ceremonies and performances

  ·              guest congregation and dispersal

  ·              deliveries and servicing

  ·              waste handling and glass disposal

  ·              equipment loading and clear-down operations

  ·              vehicle movements

  ·              contractor activities

  ·              grounds maintenance and machinery.

  4.              The premises shall operate at all times in accordance with the approved NMP.

  5.              A copy of the NMP shall be kept at the premises and made available for inspection by an authorised officer of the Licensing Authority upon request.

  6.              The Licensing Authority may request the NMP to be reviewed and updated where noise complaints or nuisance issues arise.

  7.              Any proposed amendment to the NMP shall be served on the Environmental Health Officer at least 14 days prior to the amended NMP taking effect (“the consultation period”). The licence holder shall have regard to any observations made by the Environmental Health Officer in relation to the proposed amendment during the consultation period.

  8.              All amplified music and speech within the Ballroom shall be controlled by a tamper-proof sound limiting device installed within the audio signal chain. The system used shall be approved by Environmental Health and Licensing Team.

  9.              The sound limiter shall be installed, configured and calibrated by a suitably qualified acoustic consultant who is a Member of the Institute of Acoustics or an equivalent professional body.

  10.              The sound limiter shall be configured so that the maximum internal sound levels cannot exceed the levels necessary to ensure compliance with the music noise limits specified in the premises licence conditions.

  11.              All amplified audio sources, including but not limited to DJ equipment, live band mixing desks, microphones, playback devices and auxiliary inputs, shall be routed through the sound limiter so that no amplified sound may bypass the system.

  12.              The limiter shall be configured to control overall sound pressure levels and low-frequency content.

  13.              The limiter shall incorporate a visual warning indicator or equivalent system to alert performers or operators when sound levels approach the configured threshold.

  14.              The limiter settings shall be secured and protected against unauthorised adjustment. Access to the configuration controls shall be restricted to the appointed acoustic consultant or member of the Environmental Health Team.

  15.              The limiter settings shall not be altered without the involvement of the appointed acoustic consultant or Environmental Health Team, and any changes shall be documented.

  16.              The Premises Licence Holder shall ensure that the sound limiter remains operational and in use at all times when amplified music or speech is played in the ballroom.

  17.              In the event of failure of the sound limiter system, all amplified music shall cease until the limiter is repaired or replaced and confirmed to be functioning correctly.

  18.              The appointed acoustic consultant shall, following installation or adjustment of the sound limiting device, provide a certificate of conformance and accompanying report to the Licensing Authority confirming that the sound limiter has been correctly configured and calibrated.

  19.              The certificate of conformance and report shall be submitted to the Licensing Authority within 28 days of installation or adjustment of the sound limiter, and a copy shall be retained at the premises and made available for inspection by an authorised officer of the Council upon request.

  20.              The noise level attributable to amplified music associated with any event within the function room shall not exceed 39 dB LAeq 5min at the boundary of any nearby residential property. Furthermore, the following noise levels attributable to amplified music associated with any event within the function room at individual low frequency octave bands shall not be exceeded at the boundary of any nearby residential property:

  44 dB Leq 63 Hz 5 min

  45 dB Leq 125 Hz 5 min

  unless otherwise agreed in writing by the Local Planning Authority and the Council.

  21.              Compliance with the Noise Limits conditions shall be determined using the following measurement protocol: Measurements shall be taken following industry practice agreed with the Local Authority.

  22.              Dhol drums

  A.              There shall be no more than 50 Dhol drum performances per calendar year.

  B.              Only 20 inch deep sized Dhol drums shall be used.

  C.              No more than two Dhol players may perform at any one time.

  D.              No more than ten minutes Dhol drumming shall occur per event.

  E.              A designated member of staff shall be present throughout the performance to ensure compliance.

  F.              No Dhol drumming shall take place in the rear garden.

  G.              Outdoor Dhol drumming shall be confined to the front fountain area. Indoor Dhol drumming is restricted to the Ballroom and Ballroom corridor.

  H.              Outdoor Dhol drumming is only permitted between 11:00 and 18:00.

  I.              Indoor Dhol drumming is only permitted between 11:00 and 21:00.

  J.              No Dhol drumming shall take place during services held at St Mary’s church.

  K.              The premises shall maintain a dedicated Webpage listing to give residents advance notice of any outdoor Dhol drumming.

  23.              The use of drones will be limited to no more than 10 minutes per event and one drone per event and in accordance with Froyle Park’s written drone policy which shall be provided to the licensing authority.

  24.              Noise monitoring data shall be retained by the premises licence holder for a period of 30 days. Upon the written request of an authorised officer of the licensing authority the premises licence holder shall provide noise monitoring data within 3 working days of the request being made.

  25.              Save for Dhol drums, acoustic drum kits are not permitted at Froyle Park. All performers must use electronic drum kits routed through the in-house sound system. Similarly, stage monitors are not permitted. Live performers are required to use in-ear monitoring systems, ensuring all amplified sound remains under control.

  26.              No outdoor ceremonies after 18:30pm. No amplified sound is permitted outside at any time.

  27.              All windows and doors will be kept closed in the Ballroom when amplified music is being played.

  28.              No amplified music is permitted in the atrium/glasshouse area.

  29.              Low level acoustic instruments (eg, string quartet, harp) are permitted externally. Loud instruments such as bagpipes, brass quartet, drums are not permitted externally. Use of all acoustic instruments will cease by 18:30.

  30.              Notices shall be prominently displayed at any area used for smoking requesting patrons to respect the needs of local residents and use the area quietly.

  31.              The premises licence holder shall ensure that any patrons drinking and/or smoking outside the premises do so in an orderly manner and are properly supervised by staff or door supervisors so as to ensure that there is no public nuisance or obstruction of the public highway.

  32.              No guests shall enter in the rear external garden area after 22:30.

  33.              No set-up activity shall take place before 08:00 Monday to Sunday.

  34.              So far as reasonably practicable, all suppliers must use Froyle Park’s low noise trollies externally during clear down (fitted with rubber wheels that minimise noise when running over a path).

  35.              Froyle Park will maintain the trollies to ensure low noise operation.

  36.              All suppliers are encouraged to commence clear down as soon as practically possible.

  37.              From 22:30 a minimum of 2 members of Froyle Park staff shall be dedicated to the quiet management of supplier departure.

  38.              No noisy garden machinery will be used before 09:00.

  39.              So far as reasonably practicable, electric leaf blowers will be used in the back garden.

  40.              The back garden shall be closed to customers from 22:30. Guests shall be routed to the front entrance if they wish to smoke.

  41.              The main gates shall be closed after 20:00 on event days.

  42.              Froyle Park must have prominent, clear and legible notices displayed on all exits requesting the public to respect the needs of local residents.

  43.              The premises adopts the following dispersal noise control measures:

                (a) A strict no loitering policy in the corridor and conservatory. This is enforced by a designated member of staff.

                (b)              A member of staff is located at the beginning of the Avenue to accompany guests to their cars, 30 minutes prior to the anticipated guest departure time.

                (c) Signage is displayed in the corridor / conservatory to remind guests to be mindful of neighbours and keep their voices lowered.             

                (d) Staff wear body cams and high vis jackets after 18:00, to promote good behaviour and encourage guests to depart in an orderly manner.

  44.              From 20:00 the premises shall operate a one-way system where vehicles depart from the Avenue directly onto the A31.

  45.              A telephone number for an on-duty manager shall be made available to residents in the event of any noise complaint. The premises shall investigate all noise complaints with a view to resolving them.

  46.              All complaints will be logged on file, kept on the premises for 12 months and made available for inspection by an authorised officer of the local authority on request.

  47.              Staff at the premises shall receive detailed training on matters relating to noise management. Refresher training shall be completed every 6 months as a minimum. Records must be kept of all training, signed and dated by the staff member(s) and person(s) delivering the training. These records must be made available for inspection by the police and an authorised officer of the local authority.

  48.              During the hours of operation of the premises, the licence holder shall ensure sufficient measures are in place to remove and prevent litter or waste arising or accumulating from customers in the area immediately outside the premises.             

  49.              Pursuant to section 177A(4) of the Licensing Act 2003, any conditions on this premises licence relating to live or recorded music (including the terms of the Noise Management Plan) are to apply and have effect notwithstanding the terms of section 177A and paragraph 12A of Schedule 1 to the Licensing Act 2003.
