ANNEX 1 - MANDATORY CONDITIONS

1. No supply of alcohol may be made under the premises licence:

at a time when there is no designated premises supervisor in respect of the premises licence, or
at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. (Section 19, Licensing Act 2003)

3. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

4. Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

PREMISES OPENING HOURS

The premises opening hours detailed in this licence are at the discretion of the licence holder.

Residents and their bona fide guests will be permitted to purchase and consume alcohol at any time, as per existing licence and grandfather rights.

These premises are entitled to provide private entertainment.

New Year`s Eve

From the end of permitted hours at 23:00pm on 31 December until the start of permitted hours at 10:00am on 1 January.

ANNEX 3 - LICENSING OBJECTIVES

GENERAL LICENSING OBJECTIVES

I have undertaken my own risk assessment to take the following proposed steps.
The types of regulated entertainment proposed materially do no more then reinstate the normal pub entertainment that was previously unregulated.
No new steps have been identified in relation to the four licensing objectives save as below.
The proposed refurbishment works are intended to improve and upgrade the premises.
The premises currently utilise the external areas for consumption and it is not anticipated that the inclusion of those areas within the licensed areas within the licensed area specifically for sale by retail of alcohol and late night refreshment will adversely affect the licensing objectives.

THE PREVENTION OF CRIME AND DISORDER OBJECTIVES

No further risks have been identified which need to be addressed.
Under the present licensing regime the premises already are able to be open until 0000/0030.

PUBLIC SAFETY OBJECTIVES

No further risks have been identified which need to be addressed.

THE PREVENTION OF PUBLIC NUISANCE OBJECTIVES

No further risks have been identified which need to be addressed.

THE PROTECTION OF CHILDREN FROM HARM OBJECTIVES

The restrictions set out in the Licensing Act 2003 will apply. No unusual or additional risks of harm to children have been identified.
                            ANNEX 4 - Notice of Decision of Review Hearing

While regulated entertainment takes place at the premises doors and windows on the side of the building closest to Havant Road will remain closed except for normal access and egress.

While regulated entertainment takes place at the premises the management will use their best endeavours to encourage patrons to leave the premises by the rear doors(into the garden) through the use of signage or staff announcements.

At all times when amplified recorded music is being played (not including background music and television screens) a noise limiting device shall be fitted and in operation which automatically cuts off music if certain noise levels are exceeded. The noise limiting device shall be set at a level to be agreed with the Council`s Environmental Health Service.
Annex 5 - Conditions attached by Environmental Protection

Noise emanating from the premises shall be inaudible at the nearest noise seneitive premises after 23:00 hours.
