• ANNEX 1 - MANDATORY CONDITIONS

   

  1. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. (Section 19, Licensing Act 2003)

   

  3. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  4.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING LICENCE

   

  General Licensing Objectives

  The plans which accompany this application indicate the proposed position for the display storage of alcohol.
  The alcohol may be displayed or stored, from time to time, in different positions within the premises.
  
  Prevention of Crime and Disorder Objectives
  The CCTV system shall be installed or the existing system maintained which is fit for the purpose. The system will incorporate a camera covering each of the entrance doors and be capable of providing an image which is regarded as identification standard.
  The CCTV system shall incorporate a recording facility and any recording shall be retained and stored in a suitable and secure manner for a minimum of one calender month. A system shall be in place to maintain the quality of the recorded image and a complete audit trail maintained. The system will comply with other essential legislation and all signs as required will be clearly displayed. The system will be maintained and fully operational throughout the hours that the premises are open for any licensable activity. If the premises are using a video recording system, the cassette tape shall be used on no more than 12 occasions.
  The precise position of the camera may be agreed with the police from time to time.
  
  Public Safety Objectives
  The applicant will at all times maintain adequate levels of staff. Such staff levels will be disclosed, on request, to the licensing authority and police.
  
  Prevention of Public Nuisance Objectives
  Signage will be displayed at the exit of the premises requesting customers leaving the premises late at night to do so quietly and with consideration so as not to disturb nearby residents.
  
  Protection of Children from Harm Objectives
  All cashiers will be trained to require evidence of age from any person seeking to buy alcohol and appearing to the cashier to be under the age of 18. This evidence shall be photographic, such as passport or photographic driving licence until other identification technology (for example, thumb print or pupil recognition) is introduced.
  Prominent notices will be displayed at points of sale advising customers that they may be asked to provide evidence of age.

  
   

   

• ANNEX 3 - CONDITIONS FROM A HEARING

   

  1.  All cashiers who may be permitted to sell alcohol to be aged 18 or over until an auditable system for the sale of alcohol by cashiers under the age of 18, to the satisfaction of the Police and Trading Standards, has been introduced;

   

  2.              Full age related training to be completed prior to any member of staff being allowed to operate a sales till;

   

  3.              Age related re-training of staff to take place every 3 (three) months;

   

  4.              Records of staff training to be kept at the store and made available to the Police, Trading Standards and members of the Licensing Authority upon request.  Such records to be reviewed monthly by the Licence Holder;

   

  5.              A written log shall be kept of all refusals, including refusals to serve alcohol.  The holder of the Premises Licence shall ensure that the refusals log is properly maintained and this shall involve, but is not limited to, nominating in writing a responsible person to check and sign the log on a weekly basis.  This log shall be made available for inspection by the Police, Trading Standards and the Licensing Authority on request;

   

  6.              The Premises Licence Holder shall ensure that a suitable and sufficient CCTV system with a recording facility for the prevention and detection of crime and disorder and for the prevention of public nuisance is operational in the premises and is maintained in full working order.  The recordings from this system must be retained for a minimum of 28 (twenty eight) days from the date of recording and be available upon request to the Police, Trading Standards and members of the Licensing Authority.

   

                The whole alcohol display area shall be covered by CCTV, to the satisfaction of the Police, Trading Standards and the Licensing Authority;

   

  7.              At least one person who is able to operate the CCTV system and produce recordings from this system be available at the store when licensable activities are taking place;

  8.              Any person supervising the checkout area to be a Personal Licence Holder.  This condition to be effective from 19 November 2010;

   

  9.              A member of staff aged 18 years or over will be present in the alcohol display area at all times when alcohol is on sale.
