Additional Conditions

• Annex 1 - Mandatory Conditions

   

  1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) Selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  4.

  (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  5. The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25ml or 35ml; and

  (iii) still wine in a glass: 125ml; and

  (b) customers are made aware of the availability of these measures

   

  6. No supply of alcohol may be made under the premises licence:

   

  ·              at a time when there is no designated premises supervisor in respect of the premises licence, or

  ·              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  7. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence (Section 19, Licensing Act 2003).

   

  8. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  9. Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

• Annex 2 - Conditions consistent with the operating schedule

   

  General Licensing Objectives

  This application is for two Contemporary Music Events per year. Event attendance will be limited to ticket holders.

  The sale of alohol will take place from a dedicated area situated inside the Premises.

  Parking will be in an area known as Middle Valley located at the bottom of Butser Hill with sufficient capacity and turning areas for the Event.

  Epouranios Music has taken advice from the safety advisory groups, in particular the police. We are employing a professional seurity team who are fully licensed. The Event is adopting zero policy to drugs, underage consumption of alcohol and offensive weapons. The Event Team will work closely with the Environmental Health team to ensure all legislation is followed to avoid occurence of noise nuisance. The Event is scheduled to finish at 2300 hours.

   

  Prevention of Crime and Disorder Objectives

  The Event Director is an experienced Event organiser, with experience of organising large Events for the general public. The Event team have identified a police officer who is involved in the Event Safety. A security firm have been employed to provide 24 hour security during the Event. Searches will be conducted on entry to the Event, any drugs and offensive weapons will be confiscated.

   

  Public Safety Objectives

  6ft fencing will be placed in areas where members of the public could come into contact with the event attendees. Security staff will patrol the perimeter throughout the Event. Car Parking will be directed by a professional company with suitably qualified staff. Floodlighting will be directed towards the Car Parking Area after event closure. The lighting will make egress from the event premises to the car park area safer. Ambulance service, First aid, Paramedics have been employed to cover  the event. Evacuation policy has been approved and is in place to ensure public safety. Consultations and advice have taken place with the responsible authorities.

   

  Prevention of Public Nuisance Objectives

  The Venue is in an isolated position with no immediate neighbours. The nearest neighbours have been identified and contacted to inform residents of the Event. The Event team are working closely with the Environmental Health team to ensure all legislation is followed to avoid occurence of noise nuisance. The last band is scheduled to finish at 2300 hours. Provision is being made to disperse attendees in an efficient manner following closure of the event. It is anticipated that the premises will be clear of attendees by midnight and that the Car Parking area will be clear by no later than 0030 hours. The Services of a Waste Disposal Company has been engaged to ensure the site is left clean and tidy.

   

  Protection of Children From Harm Objectives

  No children under the age of 16 will be permitted to attend unless acompanied by an adult. A meeting point area will be provided should young people become seperated at any time and workers in this area will be CRB checked. There will be a First Aid post. A Child Protection policy is in place and anyone who has dealings with children, will be fully CRB checked. ID will be checked pre entry to the premises. Signs will be erected at the entrance and throughout the premises stating that the sale, supply or consumption of alcohol for a minor is prohibited.

   

  Conditions agreed with Environmental Protection

  1. The music noise level (measured as an LAeq over 15 minutes) when measured at the point denoted by the purple rectangle shown at Gravel Hill, Clanfield, PO8 0QE, on the attached plan, between 09.00hrs and 23.00hrs, shall not exceed 65dB(A).

  2. Between 23.00hrs and 09.00hrs any music noise arising from licensable activities should be inaudible at the boundary of the nearest noise-sensitive premises.

  3. All noise readings shall be undertaken using a meter conforming to Class 2 or better of BS6698 and shall be made in free field conditions exterior to any building and be undertaken by a competent person.

  4. All nearby residents (within 1km of the location of the event) to be advised of an attended complaint telephone number through which noise complaints can be channelled and acted upon during the event.

  5. A log to be kept recording all complaints made relating to music noise. Details in the log should include name/location of the complainant, date/time of complaint, actions taken to address the complaint and details of any observations/noise readings (if taken) relating to the complaint.
