• ANNEX 1 - MANDATORY CONDITIONS

   

  1. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. (Section 19, Licensing Act 2003)

   

  3. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  4.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

  ANNEX 3 - LICENSING OBJECTIVES

   

  GENERAL LICENSING OBJECTIVES

   

  I have undertaken my own risk assessment to take the following proposed steps.

  The types of regulated entertainment proposed materially do no more than reinstate the normal pub entertainment that was previously unregulated.

  No new steps have been identified in relation to the four licensing objectives save as below.

   

  THE PREVENTION OF CRIME AND DISORDER OBJECTIVES

   

  Under the present licensing regime the premises already are able to be open until 0030.

  1. Any person exercising a security activity (as defined by paragraph 2(1)(a) of schedule 2 of the Private Security Industry Act 2001) shall be licensed by the Security Industry Authority.

  2. Such a person will be employed at the premises at the discretion of the designated premises supervisor/holder of the Premises Licence.

  3. Any such person referred to in condition (1) shall be linked by means of text or radio pager to the police enabling the police to be alerted to instances of crime and/or disorder (where required).

  4. Any person as defined in condition (1) will clearly display his name badge at all times whilst on duty.

  5. No customers carrying open bottles upon entry shall be admitted to the premises at any times the premises are open to the public.

  6. Toughened glasses shall be used for draft beer and lager at all times the premises are open to the public.

  7. Where CCTV is installed with recording facilities such recording shall be retained for a period of 30 days and made available within a reasonable time upon request by the police.

  8. Alcoholic and other drinks may not be removed from the premises in open containers save for consumption in any external area provided for that purpose.

  9. The maximum occupancy of the building (including staff and performers) will be restricted to 450 persons.

   

  PUBLIC SAFETY OBJECTIVES

   

  1. To comply with the reasonable requirements of the fire officer from time to time.

  2. To comply with the reasonable requirements of the building control officer.

   

  THE PREVENTION OF PUBLIC NUISANCE OBJECTIVES

   

  1. Prominent, clear and legible notices shall be displayed at all exits requesting the public respect the needs of local residents and to leave the premises and area quietly.

  2. Noise or vibration shall not emanate from the premises so as to cause a nuisance to nearby properties.

   

  THE PROTECTION OF CHILDREN FROM HARM OBJECTIVES

   

  1. Children under the age of 16 shall no be permitted to enter the premises after 1900.

  Conditions attached following a Hearing

   

  The following conditions as agreed by the parties:

   

  1.              There shall be one door staff on duty for every 100 customers on the premises  (or part thereof), (subject to a minimum of two door staff) from 2100 hours until closing.

   

  2.              There shall be no external disposal of bottles so as to be audible in any noise sensitive property between 2230 hours and 0630 hours.

   

  3.              If employed, door supervisors shall have a responsibility to seek to ensure that patrons leave the premises quietly.

   

  4.              Commercial waste collections shall not take place between 2230 and 0630 hours.

   

  5.              In order to reduce the risk of electrocution, all entertainers’ electrical equipment, including mains powered microphones, will be protected by residual current devices (RCDs) which will be tested each time before use.

   

  6.              Alcohol shall not be sold for consumption off the premises after 2100 hours.

   

  7.              No customers will be admitted to the premises after midnight.

   

  8.              If door staff circulate internally within the premises they shall wear fluorescent armbands and badges.

   

  9.              Signage to be put in place to ask customers to leave quietly.
