Annex 1 - Mandatory Conditions
1. No supply of alcohol may be made under the premises licence:
· at a time when there is no designated premises supervisor in respect of the premises licence, or
· at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. (Section 19, Licensing Act 2003)
3. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.
4. Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).
Annex 2 - Conditions consistent with the operating schedule
A written log shall be kept of all refusals including refusals to sell alcohol. The holder of the premises licence shall ensure that the refusals log is properly maintained and this shall involve, but is not limited to, nominating in writing a responsible person to check and sign it on a weekly basis.
The holder of the premises licence shall ensure that every individual who appears to be under 21 years of age seeking to purchase or be supplied with alcohol at or from the premises shall produce means of identification acceptable to the licensing authority - passport, photo driving licence or PASS accredited photo ID - proving that individual to be 18 years of age or older. If the person seeking alcohol is unable to produce acceptable means of identification, no sale or supply of alcohol will be made to or for that person.
All staff shall be trained to challenge every individual who appears to be under 21 years of age and to refuse service where individuals cannot produce acceptable means of identification. Such training shall be provided not less than every three months, and written records shall be kept of all training and refresher training.
'Challenge 21' posters shall be displayed in prominent positions at the premises.
Annex 3 - Conditions from a hearing
The Premises Licence Holder must keep complete records such as invoices, receipts and delivery notes relating to alcohol and cigarettes obtained by him or her for sale from his or her shop. Records must include the name, address and telephone number of the supplier, the date of supply, the products supplied and their prices. Where items have been delivered to his or her shop by a supplier by a vehicle, details of the vehicle registration number, the name of the delivery person and contact details including the name, address and telephone number of the business must be kept. These details must be available in request to responsible authorities within 24 hours. The Premises Licence Holder must be able to identify who supplied alcohol and cigarettes present at his or her premises.
