• ANNEX 1 - MANDATORY CONDITIONS

   

   

  1.(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
  
  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises -
  
  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -
  
  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
  
  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);
  
  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
  
  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less characteristic in a manner which carries a significant risk of undermining a licensing objective;
  
  (d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

  (e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2.  The responsible person must ensure that free potable water is provided on  request to customers where it is reasonably available.

   

  3. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either -

  (a) a holographic mark, or

  (b) an ultraviolet feature.

   

  4. The responsible person must ensure that -

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures -

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25ml or 35ml; and

  (iii) still wine in a glass: 125ml;

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.

   

  5. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  6. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence (Section 19, Licensing Act 2003).

   

  7. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  8.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

   

  9. (1) A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

  (2) For the purposes of the condition set out in paragraph 1-

  (a)“duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (b)“permitted price” is the price found by applying the formula- 

                                            P = D + (D x V)

  where-

  (i) P is the permitted price,

  (ii) D is the rate of duty chargeable in relation to the alcohol as if the duty were charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i)the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence, or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

  (e) “valued added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

  (3). Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

  (4). (1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

   

   

• ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE

   

  General - All four Licensing Objectives

  Strong Management control and effective training will be provided to all staff and volunteers to meet and promote the objectives.

  No alcohol will be sold to underage individuals.
  No drunk, disorderly, violent and anti-social behaviour will be tolerated at the premises.
  The staff will be vigilant in preventing the use and sale of illegal drugs on the premises.

   

  Prevention of Crime and Disorder

  A 24 hour CCTV system is present on the premises internally and externally. CCTV recordings are held for 21 days and will be available on request by any authorised body.
  No alcohol will be sold to drunk or intoxicated customers.
  Staff and volunteers will be regularly briefed in connection with vigilance towards and the prevention of illegal drug use in the retail area.
  All-inclusive nights or other irresponsible drinks promotions will not be permitted.
  Two way radio equipment will be on at all times the premises are open to the public, and will be monitored by the Designated Premises Supervisor or other responsible staff member.
  All instances of crime and disorder will be reported to the Police as soon as reasonably practicable via C.C.T.V. or the radio.
  A zero tolerance drug policy is in effect on the premises and all staff and volunteers will be trained with how to deal with any situation where it is believed controlled drugs are involved.
  We will join a local Pubwatch scheme

   

  Public Safety
  Exit doors are regularly checked to ensure they function satisfactorily.
  Records of all these checks are kept and can be produced on request.
  All fire doors are maintained unobstructed and effectively selfclosing and will not be held open other than with approved devices.
  Hangings, curtains and temporary decorations are maintained in a flame retardant condition.
  Curtains, hangings and temporary decorations are located so as not to obstruct exits, fire safety signs or fire-fighting equipment.
  Notices detailing the actions to be taken in the event of fire or other emergency are prominently displayed and maintained in good condition.
  Access is provided for emergency vehicles and kept clear and free from obstruction at all times.
  Fire drill and emergency lighting tests are conducted weekly / monthly. Records of these tests are available upon request.
  All staff members have been trained in fire and emergency evacuation procedures.
  Exit doors open outwards or are secured in the open position if this is not the case.
  Adequate arrangements exist to enable the safe movement within the premises of disabled people and their safe evacuation in the event of an emergency.
  Adequate and appropriate First Aid equipment and materials are available on the premises.
  At least one suitable trained First Aider will be on duty when the public are present
  If more than one First Aider is present, their respective duties will be clearly defined.
  In the absence of adequate daylight suitable and sufficient artificial lighting is provided and maintained in any area accessible to the public

  Fire safety signs are adequately illuminated.
  Emergency lighting are installed and regularly maintained.
  The emergency lighting battery has a capacity of 15 minutes to allow adequate evacuation of the premises
  Emergency lighting tests are conducted monthly. Records of these tests are available upon request
  Free drinking water will be available at all times when the premises is open to the public and taps are labelled as such.
  We operate a complete no smoking policy at the premises.
  There will always be adequate number of staff/volunteers for the number of public on site.

   

  The Prevention of Public Nuisance

  Noise reduction measures will be put in place to comply with the public nuisance objective. Clear and
  legible notices will be placed in a prominent position at the exit of the premises requesting that customers respect the neighboring residents and to leave the premises and the area quietly.
  The premises lighting does not cause a disturbance to the residents of any nearby properties.
  Adequate waste facilities will be provided for the premises and its customers.
  Noise or vibration from the premises will be maintained at a level that will not be audible at the façade of any neighbouring noise sensitive premises.
  Open containers of alcohol will not be permitted to be taken off the premises.
  Litter receptacles are placed outside the premises for customers to use and are emptied at least daily.
  Staff undertake a litter pick to a distance of 50 metres around the premises after events.
  Music will be turned down 30 mins before the end of an event.

   

  The Protection of Children From Harm

  Challenge 25" notices will be displayed in prominent positions at all alcohol points of sale within the premises.
  All staff will be trained in connection with identification and age requirements.
  Film classification at the premises is done in the following way:
  U - Universal - suitable for audiences aged 4 years and over.
  PG - Parental Guidance - some scenes may be unsuitable for young children.
  12A - Viewing by persons aged 12 years or older or persons younger than 12 when accompanied by an adult.
  15 - Viewing by persons aged 15 years and over
  18 - Viewing by persons aged 18 years and over.
  All staff and volunteers will be trained to challenge any individual who they believe is not old enough to watch the film being shown. For films classified ‘18’ a challenge 25 policy is in place.
  Immediately before each exhibition of a film classified by the British Board (of) Film Censors (B.B.F.C.) a reproduction of the certificate of the Board is shown on the screen for at least five second that can be easily read by all persons in the auditorium or, as regards a trailer advertising a film, a statement approved by the Board indicating the classification of that film
  Where any staff or volunteers will be working alone with children relevant DBS checks will be run before the event
