• ANNEX 1 - MANDATORY CONDITIONS

   

  1. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. (Section 19, Licensing Act 2003)

   

  3. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  4.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

  EMBEDDED PROVISIONS

   

  It is a condition of your licence that you comply with the existing provisions of the following enactments:

   

  Children & Young Persons Act 1933

  Cinematograph (Safety) Regulations 1955

  Licensing Act 1964

  Sporting Events (Control of Alcohol etc) Act 1985

   

  DRINKING UP TIME

   

  The restrictions on the sale or supply of alcohol do not prohibit during the first twenty minutes after the permitted hours the consumption of alcohol on the premises.

   

  PREMISES OPENING HOURS

   

  The premises opening hours detailed in this licence are at the discretion of the licence holder.

   

  We do not have children in the bar under 16.

• ANNEX 3

   

  General Objectives

  I would like these hours for regular customers to enjoy, but would not allow other pubs customers to turn up late expecting drinks. I don't want to end up with everyone turning up late and drunk.

   

  Prevention of Crime and Disorder Objectives

  As in general objectives this would keep my regular clientele, which I can control on the premises myself. Also I would stop drunken people trying to get in for late drink. I would not sell alcohol to anyone already drunk. I have a policy of no disorderly conduct or it is an instant ban, which my customers respect. No one wants to be barred from Foggy's. We are also opposite the Police station which helps us.

   

  Public Safety Objectives

  As an active member of pub watch we meet regularly and discuss public safety. If we have turned people away we use a ring round sheet to inform other pubs & Police of expected trouble, thus trying to secure public and commercial interests around our town. We also ensure that we clear the road area at the end of every night from broken glass etc.

   

  Prevention of Public Nuisance Objectives

  I believe that the later licence will help as I will not be chucking out everyone at 11.20pm. People will leave in groups rather than all at once. Also I would on Friday and  Saturday nights close doors at 11pm to prevent noise and also remove outside chairs and tables thus reducing noise for the local residents. This would also stop people hanging around outside making noise.

   

  Protection of Children from Harm Objectives

  No children in pub.

• Decision of Review Hearing 18/01/08

   

  The Sub-Committee has decided to impose the following additional conditions on the premises licence as agreed between the parties, in order to prevent crime and disorder, to promote public safety, to prevent public nuisance and to protect children from harm:

                      Two SIA registered door staff on Friday and Saturday, 21:00 hours until closing. (Also to include Christmas Eve and New Year's Eve);

                      No consumption of alcohol outside the premises on Friday and Saturday after 21:30 hours. (Also to include Christmas Eve and New Year's Eve).

                      No person shall remove, or enter the premises with, any alcohol or other drink in open containers unless intended for consumption in any external area provided for that purpose; and

                      No entry or re-entry after midnight on Friday and Saturday (other than to allow customers to smoke).
