• Annex 1 - Mandatory Conditions

   

  1. (1) The responsible person shall take all reasonable steps to ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises in a manner which carries a significant risk of leading or contributing to crime and disorder, prejudice to public safety, public nuisance, or harm to children-

   

  (a) games or other activities which require or encourage, or are designed to require or encourage, individuals to -

  (i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii) drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic (other than any promotion or discount available to an individual in respect of alcohol for consumption at a table meal, as defined in section 159 of the Act);

   

  (c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less;

   

  (d) provision of free or discounted alcohol in relation to the viewing on the premises of a sporting event, where that provision is dependent on-

  (i) the outcome of a race, competition or other event or process, or

  (ii) the likelihood of anything occurring or not occurring;

   

  (e) Selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner.

   

  2. The responsible person shall ensure that no alcohol is dispensed directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of a disability).

   

  3. The responsible person shall ensure that free tap water is provided on request to customers where it is reasonably available.

   

  4.

  (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol.

  (2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark.

   

  5. The responsible person shall ensure that-

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25ml or 35ml; and

  (iii) still wine in a glass: 125ml; and

  (b) customers are made aware of the availability of these measures

   

  6. No supply of alcohol may be made under the premises licence:

   

  ·              at a time when there is no designated premises supervisor in respect of the premises licence, or

  ·              at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  7. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence (Section 19, Licensing Act 2003).

   

  8. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  9. Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

  Decision of Hearing 20/12/11

   

  1.              The venue capacity is 250 people, including staff, DJ’s and door staff.  Venue capacity will be measured at the front door using clickers in possession of the on duty door staff, for persons entering the premises and for persons exiting the premises.  The clickers to be used at the times door staff are employed;

   

  2.              Two SIA registered door staff on Friday and Saturday, 21:00 until closure.  Also to include Christmas Eve, New Year’s Eve and Bank Holidays and any events where the attendance is likely to be in excess of 100 people.  All door staff must document their name, SIA badge number, date and time they start and finish working at the premises;

   

  3.              No consumption of alcohol outside the premises on Friday and Saturday after 21:30.  Also to include Christmas Eve, New Year’s Eve and Bank Holidays and any events where the attendance is likely to be in excess of 100 people;

   

  4.              No person shall remove, or enter the premises with any alcohol or other drink in open containers unless intended for consumption in any external areas provided for that purpose;

   

  5.              No entry or re-entry after midnight on Friday and Saturday;

   

  6.              CCTV must be installed throughout the premises and in good working order.  The CCTV must be of good quality and recorded on a CD or DVD for download.  The recording must be retained for 31 days and made available to Police or local authorities on request.  There must be a person on site who can operate the CCTV for download at the time of request from Police or local authorities.  The premises must adhere to the wording given under the public safety licensing objective for the CCTV procedure.  If the CCTV is not in operation at the time of the hearing then it must be installed and fully operational by 20.01.2012 and maintained thereafter;

   

  7.              An incident book must be kept on the premises and all incidents recorded with a date, time and nature of the incident whether reported to the Police or not,  All paperwork must be kept on site for 12 months;

   

  8.              All staff will be trained on the Licensing Act upon induction at the beginning of their employment.  There should also be refresher training every three months.  These training records must be dated, recorded and kept on the premises for Police and other authorities to view upon request;

   

  9.              No persons under the age of 18 years are permitted in the premises after 22:00.  Persons under 18 years are permitted in the premises before 22:00 when accompanied by a responsible adult and are having a table meal or waiting for takeaway food, however they are not permitted within one metre of the bar or to purchase products from the bar;

   

  10.              The premises will adopt a ‘challenge 21’ procedure.  Any person who appears under 21 years of age will be asked for ID before purchasing alcohol.  Acceptable ID for the premises will be -          1.  Valid passport.  2.  Valid UK photo driving licence.  3.  Valid ID bearing the PASS hologram.  Challenge 21 posters to be displayed within the premises;

   

  11.              Following 20.01.2012, before first use of any amplification equipment (for either live or recorded music, singing or speech) a tamper-proof noise limiting device shall be installed, connected to all permanent music and public address equipment and all available mains power sockets within the area around the stage and/or near to the control desk;

   

  12.              Before first use of any tamper-proof noise limiting device installed in compliance with condition 11 the level at which the noise limiter operates shall be submitted and agreed in writing with East Hampshire District Council’s Environmental Protection team. 

   

  Thereafter no alteration to this agreed level shall occur until approval has been requested and agreed in writing with East Hampshire District Council’s Environmental Protection team;

   

  13.              Any tamper-proof noise limiting device installed in compliance with condition 11 shall be regularly serviced and maintained in accordance with the manufacturer’s recommendations;

   

  14.              A book shall be kept on the premises and used to record all occasions when the noise limiter has been tripped and/or reset to include date and time of the incident and the name of the person resetting the equipment;

   

  15.              Following 20.01.2012, before first use of any amplification equipment (for either live or recorded music, singing or speech) a detailed scheme for the provision of a sound trap lobby with self-closing doors to enclose the front (main) entrance to the premises shall be submitted and agreed in writing with East Hampshire District Council’s Environmental Protection team.  The agreed scheme shall then be implemented within one month following approval and maintained thereafter;

   

  16.              The location, size, method of installation (including anti-vibration mounts for any speakers fixed to the structure of the premises) and intended use of the speakers being installed in the premises shall be submitted in writing to East Hampshire District Council’s Environmental Protection team for written approval.  No alterations to the location or type of speaker installed shall occur until written approval has been submitted and agreed by East Hampshire District Council’s Environmental Protection team;

   

  17.              The door leading to the rear outside area shall be fitted with a self-closing device which shall remain operational and be maintained thereafter in accordance with manufacturer’s recommendations;

   

  18.              All windows and doors shall be kept shut after 22:00 hours when regulated entertainment is taking place, except for access and egress;

   

  19.              The outdoor patio area to the rear of the premises shall only be used for smoking purposes and shall be occupied by a maximum of 10 people at any one time between the hours of 23:00 and 08:00 hours daily;

   

  20.              No consumption of alcohol to take place in the outdoor patio area to the rear of the premises between 23:00 and 08:00 hours daily;

   

  21.              Prominent clear notices shall be displayed in the rear patio area requesting that customers respect the needs of local residents when using the area; and

   

  22.              Prominent clear notices shall be displayed at all exits requesting that customers respect the needs of local residents and leave the premises and the area quietly.
