• ANNEX 1 - MANDATORY CONDITIONS

   

  1. No supply of alcohol may be made under the premises licence:

   

  at a time when there is no designated premises supervisor in respect of the premises licence, or

  at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  2. Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence. (Section 19, Licensing Act 2003)

   

  3. Where this licence authorises the exhibition of films the admission of children must be restricted in accordance with the British Board of Film Classification.

   

  4.  Where this licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, these individuals must be licensed by the Security Authority (Section 21, Licensing Act 2003).

• ANNEX 2 - LICENSING OBJECTIVES

   

  General Licensing Objectives

  Ensure staff are aware of the Licensing Act 2003 and have read the EHDC Licensing Policy. Advise staff to Act according to the guidelines. Highlight the importance of prevention of Crime and Disorder, Public Nuisance, duty to Public Safety and Protection of children when customers are at the Gurkha Durbar.

   

  Prevention of Crime and Disorder Objectives

  Ensure no alcohol is supplied to drunk persons. Do not allow disorderly conduct, store unlawful goods, employ capable manager and staff, provide adequate training, be aware of alcohol and drug abuse and report any unlawful activity to relevant authority.

   

  Public Safety Objectives

  Liaise with Police, fire and rescue, licence holders and relevant bodies to ensure and provide a safe environment and facilities to public when they visit the Gurkha Durbar as paying customers.

   

  Prevention of Public Nuisance Objectives

  Be aware of Environmental Protection Act 1990 and Noise Act 1996 and observe relevant restrictions especially at night and weekends and public holidays. Ensure take away customers have ample parking and waiting area in the premises.

   

  Protection of Children from Harm Objectives

  Encourage children to come with family but be aware of restrictions on under age consumption of alcohol and use of drugs, violent activity, abusive language and entertainment of sexual activities.
